Resumo: O presente trabalho contém uma parte geral sobre a normalização europeia e portuguesa (Parte I), uma parte especial referente à normalização implementada aos serviços de cuidados de saúde (Parte II), e uma parte conclusiva (Parte III). Assim, se discorre primeiramente sobre um campo normativo, se bem que pouco estudado, com relevante dimensão prática no direito contratual, no direito da concorrência, assim como no domínio da responsabilidade civil, a saber, a normalização. Analisar-se-ão, portanto, as principais vertentes da normalização no seu estádio atual, os seus objetivos, os tipos de normas, os atores e agentes, os problemas e a sua evolução. É analisada, igualmente, a posição das normas internacionais, europeias e nacionais, no elenco das fontes de Direito, mais concretamente, do direito primário e secundário da União Europeia, das normas legislativas e administrativas nacionais, das cláusulas contratuais, dos atos administrativos e da jurisprudência. O posicionamento dos standards na hierarquia das fontes é debatido e são traçados os seus limites em termos de conteúdo. Os objetivos na normalização não são iguais na perspetiva dos diversos atores envolvidos. As normas, entre outras finalidades, procuram promover a exportação. Neste sentido, representam um instrumento do poder económico, muito embora os autores da normalização se encontrem sujeitos ao Direito da Concorrência e às regras do mercado interno. Assim, numa economia liberalizada, a normalização visa a compatibilização de produtos e serviços transacionados. A possibilidade de uma normalização de serviços de cuidados de saúde tem provocado veementes protestos por parte de diversos profissionais de saúde, especialmente nos países europeus com economias mais fortes. Dado que os Estados-Membros dispõem de normas de orientação clínica, que são instrumentos de clarificação das leges artis, cuja importância está plenamente demonstrada, os opositores da estandardização de serviços de cuidados de saúde receiam que se confundam estandardizações e normas de orientação clínica. Tal representaria, na sua perspectiva, uma ameaça à liberdade da terapia médica e ao direito ao tratamento individualizado. No entanto, a análise dos conteúdos das normas de orientação clínica e das normas de estandardização revela que o receio de uma uniformização excessiva não é, por enquanto, justificado. Por outro lado, a voluntariedade das normas de estandardização é apresentada como se acarretasse um elemento de insegurança jurídica quanto a questões de responsabilidade civil, apesar do objetivo da normalização ser a amplificação da eficácia das normas jurídicas. Finalmente, iremos avaliar a competência formal e material da União Europeia para definir critérios e limites à prestação de cuidados de saúde. - Se o procedimento de produção normativa deve obedecer a um conjunto de princípios democráticos, conclui-se pela deficiente observância dos princípios da transparência, da eficiente troca de informações, da representatividade e da paridade.
Descrição: This study discusses a normative area, having relevant practical dimension in contractual law, competitive law, as well as in the field of civil responsibility. This legal area still requires further work on standardization issues. The purpose of the first part of the work is to address the lack of this basic study. It analyses the main current trends of standardization, their objectives, the types of standards affected, the participating factors and agents, the encountered problems and their past and expected future evolution. It also examines the current state of international, European and national standards in the context of the sources of the law, which are the primary and secondary laws of the European Union, the national legislative and administrative standards, the contractual clauses, the pertinent administrative acts and the associated jurisprudence. The position of the different standards in the hierarchy of the sources of the law is debated and their boundaries are drawn in terms of content. The objectives of standardization are not identical from the perspective of the different actors involved. The standards, among other purposes, seek to promote exports. In this sense, they represent a powerful instrument of economic expansion, even though they are limited by the laws of competition and the internal rules of the market. The type of standardization studied in this analyse is best known as relating to products rather than services. Nevertheless, it applies to both. It inserts itself in the search for compatibility of products and services which are transacted in the context of liberalized market-driven economies. The standardization of health care services, seen in retrospect as very ambitious, has sparked vehement protests from various health professionals, especially in European countries with the strongest economies. They reacted to a perceived top-down imposition of standards, but they also presented other concerns that will be analysed here: most European Union Member States already have clinically-based guidance standards representing effective tools for clarifying the legal issues associated with Health Care, and these guidance standards have already proven their value and have had their legitimacy widely recognized. The concern is that the new proposed standards and guidelines are confusing, and ultimately unnecessary given the existing guidance standards. However, opponents of the standardization of health care services are seen to represent a threat to the freedom of medical treatment and the right of all individuals to a wide-based effective health care. Moreover, detailed examination of the contents of the existing clinical guidance standards on the one hand, and of the proposed standardization on the other hand, shows that this fear of excessive standardization is not, for the time being, justified. Since the proposed standardization is to be implemented on a voluntary basis, this is being criticized as bringing with it an element of legal uncertainty, with vaguely defined responsibilities. However, in view of the goal of standardization to act as an extension of the efficiency of existing laws, this criticism is not supported either. This study also assesses the formal and material competence of the European Union in defining the criteria and limits ruling the provision of health care. The standard-setting procedure has to comply with the applicable set of democratic principles, and its implementation must abide by the principles of transparency, efficient exchange of information, representativeness and parity.
